Terms and Conditions

While we'd love for everything in the world to run perfectly all times - the realities of life mean that we need to ensure everyone understands their commitments, and ours, when it comes to joining us on the mat.

By booking and/or attending a Yoga Class, or purchasing a Class Pass, you are agreeing to our standard Terms and Conditions, as detailed below.

1. Definitions

1.1 “sìdà yoga”, “Company” or “Provider” refers to Victoria Boast, trading as sìdà yoga.

1.2 “We”, “Us”, “Instructor”, "Our" refers to any individual or persons providing services for an on behalf of sìdà yoga.

1.3 “You”, "Your", “Customer”, “Attendee” or “Participant” refers to anyone who has booked a class, created an online account, is attending a class or has purchased a class pass/subscription.

1.4 “Class”, “Session” or “Classes” refers to the services of yoga instruction as provided by sìdà yoga.

1.5 “Class Pass” refers to the subscription product that is sold by sìdà yoga by which Classes are offered at a discount as class credits when prepaid in volume.

1.6 “Booking” or “Bookings” refers to the act of requesting attendance on a Class by a Customer – whether paid in a single transaction or when purchased as part of a Class Pass.

1.7 “Terms and Conditions” or “Terms” refers to this document, in its current format, which may change from time to time.

1.8 "Studio" refers to the sìdà yoga Studio located at Units 3-5, Victoria Building, Lerrett Road, Portland, DT5 1GB, United Kingdom.

1.9 By accessing this website (“Site”), or purchasing any Class or Class Pass from sìdà yoga, you accept and agree to be bound by and comply with these Terms and Conditions at all times.

1.10 sìdà yoga reserves the right to change these Terms from time to time and therefore Customers should check them regularly, prior to booking.

2. Bookings

2.1 Classes must be pre-booked and paid for in advance on this website or via our mobile app.

2.2 In order to deliver the best possible experience to You, We limit spaces available to book per class and cannot guarantee space for Customers who do not book in advance.

2.3 We do not accept payment for classes on arrival.

2.4 Customers who have purchased a Class Pass will have any applicable Classes that are booked being deducted from their number of remaining Sessions available to book in future.

2.5 If a class is displayed as "Fully Booked" online, there are no spaces available for any more attendees, but you may join a Waiting List pending any cancellations.

2.6 If a customer on the Waiting List confirms their acceptance of a cancelled space, payment will be required immediately in order to complete the booking.

2.7 All class prices are as displayed on this website and may be changed from time to time, but all bookings made prior to any change in pricing will be honoured at the previous price.

2.8 sìdà yoga reserves the right to refuse admittance or remove customers from a class and/or the studio should their conduct be deemed unfit, or if they have behaved in a way that is in breach of these Terms, or for any other reason at Our sole discretion. In such instances no refund will be provided to the Customer.

2.9 Class availability is offered at Our discretion, and may not include every day or date for which a regular class may be promoted.

2.10 If a payment for a Booking is refused, cancelled or rejected, You may not attend the associated Class until such payment has been made in full.

3. Class Passes

3.1 Class Passes are offered in different formats, number of Bookings included, validity periods and prices, it is the Customer's responsibility to select and purchase the one that best suits their needs.

3.2 Class Passes are assigned to one Customer and ownership may not be transferred.

3.3 Class Passes may be used to book any applicable yoga classes for the owner, or the owner plus up to 3 friends or family members to attend the same class with them.

3.4 Using a class pass to book for others while the purchaser is not in attendance will result in the Class Pass being cancelled and no refund due.

3.5 Class Passes have a validity period that begins on either the date of purchase, or at a future date of the Customer's choosing and cannot be extended.

3.6 Any unused Booking credits will not be rolled over or refunded at the end of the Class Pass validity period.

3.7 Class Passes may not be bartered or sold, but may be offered as a gift by the purchaser to another person, who will then become the sole Owner of the gifted Class Pass.

4. Health and Suitability

4.1 sìdà yoga advises Customers not to take part in any Class without first seeking medical advice if they have any concerns at all over their physical condition.

4.2 Customers with with low or high blood pressure or any cardiovascular irregularities should not attend the Class without express and written permission from a medical professional or GP.

4.3 sìdà yoga reserves the right to refuse access to any Customer if we have any doubts regarding the health or suitably fitness level of the Customer and their ability to safely take part in the Class.

4.4 Customers accept any and all risks of injury from performing exercises or movements in the Classes. sìdà yoga accepts no liability for injury to the Customer, except in so far as such injury is by law incapable of exclusion.

4.5 New Customers may be asked to fill out a Medical History Questionnaire or may be asked about their physical fitness directly by the Instructor, so the Company is better informed of the Customer’s physical condition. This form will also waive the Company’s responsibility for physical injury caused by any Class, except for in cases of gross negligence.

4.6 Those Customers who are pregnant must inform sìdà yoga of their pregnancy along with any advice that has been provided by their medical professionals prior to Booking or participating in a Class (including where the Attendee has specific medical permission).

4.7 It is Your responsibility to inform Us as soon as possible if your medical condition changes, or if you suffer any injury or illness, or if you feel any pain or discomfort during a class.

5. Safety & Hygiene

5.1 Smoking is not permitted anywhere on the premises and during any Class, whether provided at the sìdà yoga Studio or at another location.

5.2 Outdoor shoes are not permitted to be worn while in Class or at any time on Our equipment.

5.3 Customers with any form of foot complaint or skin condition must wear socks at all times during Class.

5.4 Customers must use the designated entrance to the building when entering or exiting the Studio.

5.5 Fire Exits from the Studio are clearly marked, and must not be interfered with or blocked by any Customer or their belongings at any time.

5.6 In the event of fire, Customers must make their way to the nearest available exit and gather at the meeting point in the front car park.

5.7 If a Customer is feeling unwell prior to class, they should not attend and follow our Cancellation Policy to be rescheduled where applicable.

5.8 Should a Customer fall ill during a Class, their participation in that class shall be terminated and no refund will be due.

5.9 All customers are required to use provided mat and equipment spray to clean any items that have been used by them in Class at the end of any session.

5.10 For the safety and security of all Class paricipants and our Instructors, CCTV is in use within the Studio at all times and your attendance indicates your acceptance that recordings are being captured for those purposes.

5.11 All Customers and Participants must be over the age of 16 years old at the time of their Class - unless attending a specifically marketed class for Children.

6. Cancellations & Rescheduling

6.1 Your Booking for a Class is a request for a space in a specific Class on a specific Date and may only be cancelled or rescheduled in line with these Terms.

6.2 On the rare occasion that We may be forced to cancel a class, we will aim to inform you of such a cancellation at least 4 hours prior to the stated class start time.

6.3 If We cancel a Class, you will be given the option of re-booking the same class on another available date in the future or requesting a refund to your original payment method (or Class Pass) which will be processed by us within 7 days.

6.4 We accept no liability for any consequential losses incurred as a result of Our cancellation of any Class or Service.

6.5 Booked classes may be changed or rescheduled by the Customer up to 24 hours prior to the class start time.

6.6 Changes and cancellations by You must be completed online using Your account, where any available actions and rescheduling options will be listed against the booking.

6.7 Cancellations, requests for reschedule or non-attendance of a class within 24 hours of the Class start time may not be actioned and will not receive a refund.

6.8 Should You fall ill, you may reschedule your class one (1) time, to a future date, by contacting Us using our online Contact Form or emailing info@sidayoga.com and receiving confirmation at least 4 hours prior to the stated class start time.

6.9 Failure to inform us of sickness with sufficient notice, or arriving with any form of communicable illness, will result in forfeiture or termination of your class with no refund.

6.10 Classes and Class Passes are otherwise non-refundable once booked or activated.

6.11 sìdà yoga cannot be held responsible for a particular session or instructor becoming unavailable - in such cases, We will ensure – where practically possible – that they are replaced by another instructor of suitable experience for the Class being taught.

6.12 If We believe a Booking has been made in error, as a result of a pricing mistake, or fraudulently, We reserve the right to cancel and/or refund such Booking with no further liability.

7. Timing & Behaviour

7.1 All Classes start promptly at their advertised time, and Customers should be in attendance at least 5 minutes prior to that time.

7.2 Out of respect for all Customers in the Class we ask that Participants arrive on time in order to avoid any form of disruption for others as once the Class begins, we will not allow late arrivals.

7.3 All Customers are required to remove their shoes on entering the studio.

7.4 For the comfort of all Customers, suitable clothing must be worn at all times by every Class Participant - including both top and bottom garments.

7.5 The wearing of soiled or inappropriate clothing or any examples of poor personal hygiene will result in Us exercising our right to refuse entry to a Class with no refund due to You.

7.6 If you borrow any equipment, You must use the cleaning products provided after Class to prepare for the next Customer.

7.7 Mobile phones must be switched off or put into silent mode (not vibrate).

7.8 To ensure that everyone can experience class with minimal distractions, talking should be kept to a minimum once the Class begins.

7.9 Customers are asked to keep noise to a minimum when entering the Studio building, and be considerate to other Customers and users of the building while waiting.

7.10 sìdà yoga has a zero tolerance policy towards abusive, rude or inappropriate behaviour - whether directed at Us or any other Customer or member of the public.

7.11 We are committed to providing an environment which is inclusive, and free from any form of bullying, harassment, victimisation or unlawful discrimination - in any such cases, those involved in displays of such behaviour will be removed from Class without refund or recourse and may be permanently excluded at Our sole discretion.

7.12 We will not accept rude, abusive, intimidating or inappropriate behaviour or language in our Studio, towards our Instructors, nor through any of our communications channels (website, email, phone, social media or otherwise).

7.13 sìdà yoga reserves the right to exclude or remove Customers from the studio (including from future Classes) should their conduct (whether verbal or written) be deemed unfit or in breach of these Terms. This right can be exercised at our sole discretion and in such instances We will not refund the Customer for any current or future Classes or Class Passes that have been purchased.

7.14 For any Customer complaints, please refer to the ‘Complaints’ section below.

8. Personal Belongings

8.1 Personal belongings brought to the Studio and/or Class are brought at the Customer’s risk.

8.2 While We will provide allocated storage areas for such personal items, the safety and security of these possessions are the sole responsibility of the Customer and We accept no liability for any loss or damage, however caused.

8.3 Cars parked at the Studio Car Park are done so at the owner's risk, and We accept no liability for any loss or damage as a result of using this facility.

9. Content & Copyright

9.1 All site content is © ​sìdà yoga, all rights are reserved.

9.2 No part of this website may be copied, republished or in any way used or redistributed without our express permission.

9.3 All class content is the unique and copyrighted content of ​sìdà yoga and may not be repeated, recorded or performed without our express permission under any circumstances.

10. Limitation of Liability

9.1 sìdà yoga cannot be held responsible for any service or equipment not being available for whatever reason.

9.2 We reserves the right to make alterations to the types of facilities and Classes provided, without notice, and in our absolute discretion.

9.3 We shall not be liable for any loss incurred by such alterations except insofar as loss is by law, incapable of exclusion.

9.4 It is the Customer’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any Class that they Book or attend.

9.5 Customers accept the risk of injury from performing exercises and following any instruction provided in a Class and are advised to consult their doctor prior to beginning any new form of fitness regime.

9.6 sìdà yoga does not represent, warrant, undertake or guarantee:

•    that you will not suffer from any injury arising directly or indirectly out of our Classes;

•    that your fitness will measurably improve as a result of participation in our Classes; or

•    that the Classes will continue to run for any specific period.

11. Law & Jurisdiction

11.1 These Terms and Conditions shall be governed by and construed in accordance with English law, and any related disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11.2 All site content E&OE excepted.

12.2 No other form of correspondence will be accepted as a formal complaint.

12.3 Complaints will be acknowledged within 5 working days.
